ERA Environmental Management Solutions, hereafter known as “the Company”, will provide all that is required to host and to meet the performance and functionality of the solution as described in the proposal. Your company, hereafter known as “the Customer”, will provide all that is required by way of hardware and internet connection for the solution to perform as described in the proposal. A failure to deliver necessary items in a timely manner could result in delay of delivery of the project; in such a case, the date of delivery of the product will be extended for a period of time equivalent to the delay in supplying what is required.


Upon purchase, the Customer becomes the owner of the data hosted and generated by the Company. Therefore, the Company does not assume responsibility for the content of the event setups, reminders, and reports generated using the ERA Compliance on Demand solution.


By using the Compliance on Demand module, the Customer acknowledges that the Company cannot be held liable for any consequences resulting from actions taken involving the use of the module. The module is available in an “as in” state and the Company vouches for its accuracy in compliance with EPA health and safety regulations until edited in any manner.


These terms relate to the specific material designated and may not be valid for such material used in combination with any other materials or in any process. They are, to the best of the Company's knowledge and belief, accurate and reliable as of the date compiled. However, no representation, warranty or guarantee is made as to its accuracy, reliability or completeness, no warranty of merchantability, fitness for any particular purpose, or any other warranty, express or implied, is made concerning the information herein provided. It is the Customer’s responsibility to satisfy itself as to the suitability and completeness of such information for its own particular use. The Company does not accept liability for any loss or damage that may occur from the use of this information, nor does the Company offer warranty against patent infringement.

REFUND POLICY:

Should the Customer encounter a technical difficulty or otherwise be dissatisfied with the solution as delivered, the Customer may submit a request for support at GHS_support@era-ehs.com. The Customer must allow five business days for the resolution of the request before deeming it unresolved or irresolvable and requesting a refund for the purchased product via email. The Customer will not be entitled to a refund if the total allotted monthly amount of SDS has been exhausted or if the Company determines with certainty that no technical issues preventing the Customer from making use of the product have been found. The Company reserves the right to determine whether the conditions for a refund are met in any such case.

The Customer of a "No Contract On Demand" package will be issued a pro-rated refund in the form of a percentage of the sale price equivalent to the percentage of SDS out of the allotted monthly amount that have not been authored

The Customer of a "One-Year Commitment Plan" package is entitled to a partial refund provided the refund request is made within the first billing period, up to 30 days from the initial date of purchase. The Customer will be issued a pro-rated refund in the form of a percentage of the sale price equivalent to the percentage of SDS out of the allotted monthly amount that have not been authored. The Customer will subsequently be released from all future payment obligations.

One-time annual payments will be refunded in their entirety with the exception of the portion of the sale price corresponding to the first month of use (1/12th of the total sale price), which will be refunded in the aforementioned pro-rated manner.

Refunds will be applied to the same account, and using the same method of payment, used to place the order. ERA will endeavor to process all refund requests within 10 business days.
